FORCE MAJEURE

If Heritage Valley Resort is delayed or unable to provide some or all of the facilities or services contemplated herein for any reason whatsoever, including fire, accident, governmental authority, strikes, lockout, inability to obtain or delay in obtaining materials, supplies, equipment or adequate staffing, flood, act of God, climatic conditions, interference of the Host or the Hosts agents or any other event beyond its control, then Heritage Valley Resort may at its sole option alter or replace any such facility or service, cancel any or all said facilities and services and in such case will not be liable to the Host or any other person for any costs, damages or inconveniences which may arise.
