INDEMNITY

The Host agrees to indemnify and hold harmless with waiver of subrogation Heritage Valley Resort, SMK Investments Inc., and its directors, officers, agents, employees and representatives from any and all liability for any loss, damage, expense or injury, including death that the Host or any of the Hosts guests, agents or invitees may suffer as a result of, or arising from the use of the Heritage Valley Resort facilities due to any cause whatsoever. The Host is responsible for the conduct of guests, invitees, agents, and any damages caused or incurred to Heritage Valley Resort’s facilities by any one or more of them. Heritage Valley Resort reserves the right to discontinue service to any or all guests. The Host shall remain liable for all amounts owed to the Heritage Valley Resort and shall have no right to obtain a refund of any deposits paid to Heritage Valley Resort. The Host will be responsible for the arrangement of any liability insurance that might be required for the event and that Heritage Valley Resort will be an additional named insured. Due to the natural rustic environment children are permitted in designated function areas only and must remain under adult supervision at all times.
